At times, the manager is the problem. Remember to communicate directly in the notice and to give the terminated employee a little space. o Put the employee into escalating discipline for terrible performance and misbehavior issues. o References to the poor performance or misbehavior. Not only should you follow all processes for disciplinary action or warnings, but you also should write everything down. o Has the supervisor estimated the lay off risk suitably? While not pleasant, keep in mind that terminating employees for misbehavior is necessary if you wish to build a strong and viable company. There are times when terminating someone for an unlawful or stupid reason is cheaper (in time, money and emotion) than keeping the person on.

You must develop a policy to document worker problems suitably. So you must deal with the insubordinate employee immediately and professionally. The ultimate goal of downsizing is to ensure the company's survival. While a layoff is always a regrettable and naturally emotional, it is far better to give everyone a day or so to cool off before beginning the termination.
